In the last two decades, the world has witnessed a crisis of legitimacy in the investor-state dispute settlement (ISDS) system. Multiple criticisms of the system have resulted, on the one hand, in the resignation of ICSID by several countries in Latin America, such as Bolivia, Venezuela, Honduras, and Ecuador, although the latter has recently decided to return to the system; and, on the other hand, in the termination of investment treaties, particularly by developing countries in the Latin American region. In reaction to these criticisms, several reform initiatives have emerged, including procedural and substantive reforms, as well as the contractualization of investment arbitration. In this lecture, such reform initiatives will be addressed, delving into the main challenges of implementing these reforms.
