Regulation of the legal profession

I have been a lawyer for fifteen years, and for over ten years I have been dealing with issues related to the legal profession from a regulatory, academic, educational, and practical perspective. During this time, I have been involved in the preparation of a new law on lawyers, the almost complete overhaul of the regulations governing the Bar Association, and the preparation of a commentary on the law on the practice of law. I also have the privilege of introducing the challenges, principles, and everyday practice of our profession to the new generation of law students. It was obvious that I should choose a field of research in which I could use the knowledge and experience I had acquired, as a kind of conclusion to an era. 

The regulation of the legal profession—like any self-respecting regulation—is based on a number of principles of fundamental importance, which are reflected in the text of the law with varying intensity depending on the time and legal institution. They are regularly referred to in everyday practice, and even in the practice of bar associations, courts, and constitutional courts, to support our arguments and conduct. Furthermore, these principles are not at the same level of abstraction, do not necessarily form a coherent system, and are often contradictory, canceling each other out. What is true of all of them is that they only exist as long as we believe in them, as long as we refer to them, as long as rules and decisions are made in their name, as long as we rely on them in complex legal issues, and even unnoticed in our daily routine.

As my first topic, I wanted to choose a legal institution in which the combined effect of several potential fundamental principles prevails and which, as a closed, compact legal institution, can be easily summarized. It soon became clear that not only was the conflict of interest of lawyers not enough for a single chapter, but it offered so many topics and branches that I even had to narrow it down to the causes of conflict of interest of lawyers. However, I plan to analyze other legal institutions using the same method.

Administrative court procedure law

One focus of my research is administrative procedural law, its regulation and practice. Within this, I focus particularly on legal remedies, their application, immediate legal protection, issues relating to interested parties, the scope of procedural law, atypical types of claims, and the principle of case concentration.

legal codification

My research focuses on normative acts and provisions of general application. The main issues are their wording, structure, binding force, and contestability.
